The rules of the road

SmartJobLinks provides a specialized career platform tailored to Caribbean professionals and employers. Our services include:

• AI Smart Matching: A proprietary bidirectional scoring system that evaluates candidate fit based on skills, salary expectations, and timezone compatibility.
• Verified Job Listings: A curated database of remote, hybrid, and local roles that undergo manual review to mitigate scams, multi-level marketing (MLM) schemes, and fraudulent postings.
• Salary Intelligence: Real-time, data-backed insights regarding compensation trends across various Caribbean territories and roles.

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during the registration process.
• Maintain the security of your password and accept all risks of unauthorized access to your account.
• Notify us immediately if you discover or suspect any security breaches related to the Platform.
• You must be at least 16 years of age to use this Platform. We reserve the right to suspend or terminate accounts that we reasonably believe misrepresent skills, company status, or identity.

3.1 For Candidates

Candidates may use the Platform to search for employment opportunities and utilize AI Smart Matching. You agree not to:

• Post false or misleading resume information.
• Misrepresent your professional qualifications or location.
• Use the Salary Intelligence data for any commercial resale purpose.

3.2 For Employers

Employers may use the Platform to post job listings and source talent. You agree to:

• Post only bona fide job opportunities.
• Refrain from posting scams, MLMs, “get rich quick” schemes, or positions requiring upfront fees from candidates.
• Comply with all applicable labor laws in the relevant Caribbean jurisdiction where the role is based or where the candidate is located.

The Platform utilizes proprietary algorithms to provide “Matching Scores.” You acknowledge that:

• Scores are generated based on data provided by both candidates and employers.
• Matching scores are for informational purposes only and do not constitute a guarantee of employment or candidate performance.
• SmartJobLinks is not responsible for any hiring decisions made based on these scores.

The Salary Intelligence provided on the Platform is based on aggregated data and market trends. While we strive for accuracy, these insights are estimates and should not be construed as legal, financial, or professional advice. SmartJobLinks shall not be liable for any discrepancies between the Platform’s data and actual salary negotiations.

SmartJobLinks employs a manual review process for job listings to maintain a high-quality, scam-free environment. However, we do not guarantee the absolute validity of every listing. A “Verified” badge indicates the listing was reviewed by our team at the time of posting; it is not a guarantee of the employer’s future conduct. Users are encouraged to exercise due diligence before sharing sensitive personal information with prospective employers or employees.

The Platform, including its “AI Smart Matching” system, branding, design, and Salary Intelligence database, is the exclusive property of SmartJobLinks. You are granted a limited, non-exclusive, non-transferable license to access the Platform for personal or internal business use. You may not scrape, crawl, or data-mine the Platform without express written consent.

Certain services on the Platform may require payment. Payments are processed via Stripe. Subscriptions (including Silver, Gold, and Platinum plans, where offered) may auto-renew unless cancelled via your dashboard. We reserve the right to change our pricing at any time, with notice provided via the Platform or email.

• No Guaranteed Uptime: While we strive for 24/7 availability, we do not guarantee the service will be uninterrupted.
• Refunds: All sales are final. Refunds for service interruptions are granted at the sole discretion of SmartJobLinks LLC and are typically only considered for downtime exceeding 72 consecutive hours, unless otherwise required by applicable law.
• Proration: We do not offer proration for partial months of service.

To the maximum extent permitted by law, SmartJobLinks shall not be liable for any indirect, incidental, special, or consequential damages resulting from:

• Your use or inability to use the Platform.
• The conduct or content of any third party on the Platform.
• Any employment relationship formed through the Platform.
• Errors or inaccuracies in the AI Smart Matching scores or Salary Intelligence.
• Site downtime or service interruptions, including any “lost profit” damages.

Our total aggregate liability to you for any claims arising out of or relating to the Platform or these Terms is capped at the amount paid by you to us in the twelve (12) months immediately preceding the event giving rise to the claim.

Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to the collection and use of your data as outlined therein, specifically for the purpose of facilitating employment connections within the Caribbean region.

SmartJobLinks relies on third-party providers including, but not limited to, Vercel (hosting), Brevo (email), and Neon (database).

• You acknowledge that we do not control these external services.
• SmartJobLinks is not liable for any loss of data, service outages, or business interruptions caused by the failure, insolvency, or technical issues of these third-party providers.

SmartJobLinks shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to: Acts of God (hurricanes, earthquakes, floods), acts of war, terrorism, riots, embargos, acts of civil or military authorities, fire, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

Platinum-tier employers may upload contact databases and send campaigns through their own connected mailbox (Gmail, Google Workspace, Microsoft 365, or similar). When you use this feature, you agree to the following:

• Permission attestation.Every contact list you upload requires you to confirm that you have a lawful basis to email each contact — whether through prior express consent (CASL, GDPR, JDPA, BDPA), an existing customer or business relationship, or another permission recognised by the jurisdiction the contact resides in. Your attestation is recorded with timestamp and IP address.
• Prohibited use.You may not use the outreach feature for purchased lists, scraped data, unsolicited cold outreach to recipients with whom you have no pre-existing relationship, or content that is fraudulent, harassing, deceptive, or otherwise unlawful in the recipient’s jurisdiction.
• Mailbox liability. Campaigns send through your connected mailbox, from your email address, on yourdomain. You are solely responsible for deliverability, sender reputation, regulatory compliance in your jurisdiction and the recipient’s, and any consequences of recipient spam complaints to your email provider.
• Unsubscribe. Every outbound email automatically includes a working unsubscribe link. Unsubscribed contacts are added to a suppression list and excluded from all future campaigns from your account.
• Enforcement. We may, at our sole discretion and without prior notice, throttle, suspend, or terminate access to the outreach feature (or your entire account) if we receive credible reports of spam, abuse, or violations of the prohibitions above; if your sending volume or pattern triggers our abuse-prevention systems; or if a provider (Google, Microsoft, or any future integration) requires us to do so to maintain the integrity of the integration.
• Data processing. SmartJobLinks acts as a processor of your uploaded contact data on your behalf, for the sole purpose of facilitating the outreach campaigns you choose to send. We do not share, sell, or use the contact data for any other purpose. You may delete any contact, or your entire contact database, at any time from your dashboard.

We reserve the right to suspend or terminate your account and access to the Platform at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or the Platform’s integrity.

These Terms shall be governed by and construed in accordance with the laws of Jamaica, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.

SmartJobLinks reserves the right to modify these Terms at any time. We will notify users of material changes at least fourteen (14) days in advance via email or a site banner, and by posting the updated Terms on the website. Your continued use of the Platform after such changes constitutes acceptance of the new Terms.
